That's not remotely true. something can have both copyright and patent protection.
 
it's common for software to have both.
 
keep in mind I don't actually like software patents.
 
one does not preclude the other.
 
You could probably copyright the sequence of a synthetic gene and patent the manner in which it actually works.
Likewise you can copyright the code running on a widget while patenting the widget.

Twitter and EFF are both working on patent pools and public patent
pledges to try and achieve an escrowed public benefit use of patents,
essentially a promise only to use patents defensively against patent
trolls.
