Couldn't one be careful enough to order small oligos and slowly piece them together? At 20-30bp the chance of actually detecting what the oligo is for would be nigh impossible. This is of course assuming that they know what they need from the get-go. You could order custom genes and purposefully have them cut in such a way as to be hard to detect. Either way the chances of anyone actually coming up with a functional construct are so slim. People are having a hard enough time building benign systems like glowing plants... Making it harder for the DIYer to procure oligos will only make things frustrating, not safer.
