I guess you'd have to add a trustee to hold the patents with no other
reason to be except to execute the trust, and have that drawn up to benefit the public.
Trusts that benefit the public have plenty of legal precedent and work well.

It's all rather complicated compared to copyright + license --> GPL copylefting.
